1. TERMS OF USE & SERVICE AGREEMENT

1.1. Service Overview & Retake-as-a-Service Model

scoreBoost ("scoreBoost", "we", "us", or "our") operates an automated, high-velocity "Retake-as-a-Service" diagnostic evaluation platform for recruitment agencies, healthcare trusts, and educational partners. The platform provides artificial intelligence-driven diagnostic scoring and feedback for standardized English proficiency assessments, including IELTS (Academic and General Training) and OET (Occupational English Test for Nursing, Medicine, and Allied Health Professions).

1.2. Zero-Registration Passcode Access & Authentication

Access to the candidate evaluation interface located at scoreboost.app/portal operates on a "Zero-Registration" authentication model. Candidates are granted single-tenant session access via unique alphanumeric passcodes issued by Enterprise Clients or directly by ScoreBoost.

  • Passcode Expiration & Velocity Rules: All evaluation passcodes carry a strict 14-day operational validity window commencing automatically upon initial redemption inside the candidate portal. Upon expiration of the 14-day window, any unconsumed evaluation credits linked to that passcode are permanently deactivated without entitlement to rollover or refund.
  • Track Locking: Passcodes are non-transferable once activated. Upon initial login, the candidate's selected exam track (e.g., OET Nursing, IELTS Academic) is permanently linked to that passcode record to preserve rubric integrity and prevent credential sharing.

1.3. Acceptable Use Safeguards

Users and Enterprise Clients agree not to misuse the platform. Prohibited activities include:

  • Attempting to reverse-engineer, decompile, or extract underlying AI evaluation prompts, proprietary Voiceflow agent architecture, or rubrics.
  • Utilizing automated scripts, bots, or scrapers to submit synthetic or non-human inputs to the evaluation engine.
  • Submitting unlawful, toxic, defamatory, or infringing content.
  • Reselling individual passcodes to unauthorized third parties outside authorized recruitment workflows.

1.4. Intellectual Property Rights

All software, proprietary AI prompts, voice routing workflows, evaluation algorithms, branding, and documentation accessible via scoreboost.app remain the exclusive intellectual property of ScoreBoost Technologies Ltd. Clients retain ownership of their applicant database records, while candidates retain ownership of their original submitted text and audio responses.


2. PRIVACY POLICY & DATA PROCESSING (UK GDPR)

2.1. Statutory Compliance

ScoreBoost Technologies Ltd is committed to protecting data privacy in full compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For candidate diagnostic evaluations, ScoreBoost operates primarily as a Data Processor on behalf of Enterprise Clients (Data Controllers).

2.2. Categories of Information Collected

Because ScoreBoost utilizes a Zero-Registration architecture, we minimize personal data collection to the structural minimum required to deliver accurate diagnostic feedback:

  • Evaluation Input Data: Candidate-submitted writing samples (essays, referral letters), recorded voice audio responses, and prompt interaction logs.
  • Technical & Session Telemetry: Anonymized IP addresses, browser user-agent strings, system timestamps, and passcode validation logs.
  • Commercial & Billing Data: Payment details, corporate contact information, and billing metadata processed securely via Stripe. ScoreBoost does not store full credit or debit card numbers on its servers.

2.3. Data Retention & Automatic Purge Schedule

Candidate evaluation data (submitted text, voice transcripts, and AI-generated scoring feedback) is retained in active encrypted databases only for as long as necessary to populate agency dashboard reports. All diagnostic submission records are automatically archived and scheduled for permanent purge 30 days following passcode expiration.

2.4. Third-Party Data Sub-Processors

We transmit data to vetted sub-processors under strict Data Processing Agreements (DPAs):

  • Stripe Inc.: Payment processing, invoice generation, and merchant transaction verification.
  • Airtable (Formagrid, Inc.): Encrypted passcode database management, usage metering, and state validation.
  • Voiceflow Inc.: Conversational AI engine execution, dynamic agent branching, and dynamic evaluation routing.

3. WHOLESALE & B2B REFUND POLICY

3.1. B2B Wholesale Unit Purchases

ScoreBoost operates exclusively on a Business-to-Business (B2B) wholesale pricing model structured into tiered evaluation bundles ($375 / $750 / $1,650). Due to the immediate provisioning of digital evaluation capacity, API allocations, and software instance setup upon payment completion, all wholesale evaluation bundle purchases are strictly non-refundable except as provided in Section 3.2.

3.2. Limited Refund & Service Credit Eligibility

A B2B Enterprise Client may request a pro-rated refund or platform service credit strictly under the following conditions:

  • Unactivated Bundle Guarantee: Written request sent to legal@scoreboost.app within 7 days of purchase, provided that 0% (zero) of the generated passcodes within that bundle have been activated or redeemed.
  • Documented System Unavailability: Confirmed, continuous ScoreBoost system downtime exceeding 72 consecutive hours that prevents candidates from completing time-sensitive evaluation sprints.

3.3. Expiration of Unused Passcodes

Unused passcodes or remaining evaluation credits that expire after the 14-day validity period will not be refunded, re-issued, or credited back to the client account.


4. GOVERNANCE, JURISDICTION & CONTACT

4.1. Governing Law & Forum

These terms, their subject matter, and their formation shall be governed by and construed in accordance with the laws of England and Wales. The courts located in London, United Kingdom shall have exclusive jurisdiction to settle any dispute or claim.
